Terms of service
Glass Onion Ltd. (below 'Glass Onion') sells the products on its website exclusively to retailers and end consumers. All Orders that clearly do not constitute a retail, and in general, any fraudulent order or considered such in the exclusive opinion of GLASS ONION, will be considered void and as never received.
The Buyer declares and guarantees that the purchase of products on the GLASS ONION website is not carried out in the course of his professional activity, and is intended for strictly personal use.
For the purposes of these General Terms of Sale, the Buyer and GLASS ONION are individually or jointly referred to as the Party or Parties respectively.
Article 1 – Subject
These General Terms of Sale (below, 'CGV') are intended to inform each potential Buyer of the terms and methods by which the seller (below 'GLASS ONION' or 'Seller') sells and delivers the products ordered and, on the other hand, to define the rights and obligations of the Parties in relation to the sale of the products by GLASS ONION. CGVs apply, without limitation or condition, to all sales of products offered by GLASS ONION on its website www.staminalis.it (below the "Site" or "The Website").
GLASS ONION reserves the right to change these General Terms of Sale at any time. In any case, the General Terms of Sale applicable to an Order are always those accepted by the Buyer at the time of the submission of the Order.

Article 3 – Contract training and sending orders
Prices of products The prices of the products offered for sale on the GLASS ONION website, are indicated in Euro and are the prices in force at the time of the submission of the Order by the Buyer. GLASS ONION can change the sales prices of products at any time and without notice. This change will be reported to the Buyer before any Order is submitted.
The prices of the products offered for sale on the Website are applicable in the context of remote selling over the Internet and may differ from the retail prices applied in THE GLASS ONION stores in the territory.
Product prices include VAT applicable when the Order is submitted. Any changes to the applicable VAT rate will be automatically reflected in the price of products sold by GLASS ONION through the Site.
Product prices do not include the cost ofwhich are calculated and invoiced in addition to the price of the products. Shipping costs vary depending on the shipping method selected by the Buyer when the Order was submitted and are displayed in the Order summary before the Buyer requests the Order to confirm the order. Shipping costs are described below in these General Sales Terms and can be changed at any time by GLASS ONION, but the changes will not be applied to Orders already submitted and accepted by GLASS ONION.
GLASS ONION invites the Buyer to consult the General Terms of Sale on a regular basis.
The different shipping methods are as follows article 5 of these General Terms of Sale. The costs and times for different modes of delivery can be found in the Shipping Costs and Times section.
3.2 Product Features
The Buyer can select one or more products and/or services from the different categories available on the GLASS ONION website.
GLASS ONION may change the assortment of products offered for sale on its Website at any time, especially on the basis of reasons for its suppliers and/or information about them such as prices, description or availability of products, without obligation to notice. GLASS ONION will not make any changes to the price, availability or description of any product after GLASS ONION accepts the Order submitted by the Buyer.
Before submitting the Order, the Buyer can view on the GLASS ONION website all the information referred to in Article 52 of the Legislative Decree 6 September 2005, No 206 ('Consumer Code') which, for example, is limited to the details of the Seller, price, including taxes and shipping costs, the essential characteristics of the product(s) or the services he wishes to purchase and together with all other required information provided by Italian law.
The products comply with the applicable legislation in Italy in force at the time of the Order. GLASS ONION cannot be held responsible for non-compliance with the legislation of the country in which the Buyer wishes delivery to be made. The Buyer is required to check with the local authorities in the country of delivery of the products how to import and/or use the products and services he intends to order. GLASS ONION cannot guarantee that the information on the packaging of the products will be translated into all the languages of the European Union. However, this information will be available at least in Italian.
3.3 Product Availability
The offers submitted by GLASS ONION are valid for as long as they are posted on the Site and within the limits of the available inventory.
For products not immediately available in GLASS ONION warehouses, the offers published on the site will be valid with reserve availability. Product availability information will be provided to the Buyer when sending an e-mail confirming the receipt of the Order ("Order Confirmation E-mail"). Because this information comes directly from suppliers, GLASS ONION cannot rule out occasional errors or changes.
In any case, and in the event that, after the order is sent, there is a total or partial unavailability of the product, the Buyer will be immediately informed by e-mail of the unavailability of the product and the total or partial cancellation of the Order.
In the event of a total cancellation of the Order:
– The cancellation of the Purchaser's Order will take place automatically, without any charge toBuyer's own load.
– GLASS Onion Customer Service will contact the Buyer to inform them of the cancellation and to propose that they make a new Order excluding the product not available.
In the case of partial cancellation of the Order:
– The Purchaser's Order will be partially confirmed by charge of the amount only for the products available as indicated in the Order Confirmation email.
– The available products will be delivered to the Buyer.
3.4 Product Order
Each Order submitted by the Buyer involves acceptance of Legal Information and Privacy, and constitutes an offer to purchase GLASS ONION products.
Orders are subject to the acceptance of GLASS ONION which reserves, at its sole discretion, to refuse the Order, including cases where:
(I) Orders cannot be executed due to an error in the information provided by the Buyer at the time of the order's submission (for example: a payment card number, expiration date, or the security code number of the card used for incorrect payment); incorrect billing address (for example, if the indicated billing address does not match the information held by the bank or company that issued the payment card); incorrect or incorrect shipping address (e.g. wrong address, city, country, or cap); or if misleading information is provided by the Buyer;
(II) an error occurred on the Website regarding the products ordered, such as an error regarding the price or description of the products as shown on the Site;
(III) the products you ordered are no longer available on the Website.
GLASS ONION also reserves the right to suspend or cancel the fulfillment of an Order and/or delivery, regardless of the nature and progress of the evasion, in case of non-payment or partial payment of any amount owed by the Buyer, in case of problems with payment, that is, in the case of fraud or attempted fraud related to the use of the GLASS ONION Website, also with reference to Previous Orders.
If the GLASS ONION Order is rejected, it will inform the Buyer, within 30 business days of submitting the Order, that the Order cannot be accepted. The Buyer will be able to check the details of their Order and correct any errors before confirming/sending the Order.
Once the Buyer confirms the Order by clicking on "Confirm the Order", the Buyer declares that he has knowingly accepted the content and conditions of the Order in question and, in particular, the present General Terms of Sale, prices, volumes, characteristics, quantities and delivery times of the products offered on sale and ordered by the Buyer.
After the submission of the Order, the Buyer can still cancel his Order within 24 hours by contacting GLASS ONION or, according to the law, resorting to the right of withdrawal.
The sale will be final only at the time of the acceptance of the Order by GLASS ONION, by sending an e-mail confirming the receipt of the Order to the Buyer, the e-mail confirming the Order. A second e-mail will be sent to the Buyer at the time of the shipment of his Order.
GLASS ONION will be entitled to collect the full price of the Order:
– for payments made by credit card and/or online vouchers: from the time of sending the Order Confirmation Email;
– for payments made with other payment methods described in the next article 4.1: from the time of sending the e-mail informing the Buyer of the shipment of his Order.
GLASS ONION recommends that the Buyer keep the emails received from GLASS ONION on the cart standaceo or electronic. The Buyer is informed that these e-mails will be sent to the e-mail address entered by the Buyer at the time of the creation of the Account and/or subsequent registration. GLASS ONION will not be liable for entering an invalid e-mail address and/or not receiving the Order Confirmation E-mail for reasons not directly attributable to GLASS ONION. In this case, the sale will be considered as final. However, the Buyer may exercise the right of withdrawal according to the law.
Article 4 – Payment
4.1 Means of Payment
The Buyer assures GLASS ONION that he has the necessary permissions to use the payment method chosen for his Order when sending the Order.
4.1.1 Credit Cards
The credit cards accepted on the GLASS ONION website and at GLASS ONION Customer Service are as follows: Visa, American Express and Master Card.
4.1.3 Online vouchers
Online vouchers are a credit issued exclusively by GLASS ONION in Italy and usable by the beneficiary only on the GLASS ONION website, excluding GLASS ONION stores. It is valid for one year from the issue date.
4.2 Payment methods
The payment can be made online, at the time of the Order, by the Buyer by credit card, Paypal, online vouchers or by advance bank transfer.

All Orders are payable in Euros, taxes and mandatory contributions included. Any bank charges will be borne exclusively by the Buyer (even in case of reimbursement).
In the event of a non-payment or delayed payment of the Order by the Glass ONION Buyer, the right to apply the moratorium interest equal to the legal interest rate from the tenth business day after the order date or notification of the rejection of the bank payment.
GLASS ONION reserves, in any case, the right to suspend or cancel, at its own discretion and at any time, the execution of an Order and/or the shipment of products ordered in case of non-payment or partial payment of any sum paid by the Buyer, in case of late payment or in case of fraud or attempted fraud through the use of the Glass ONION Website, also in relation to previous Orders.
4.3 Security in Payment Transactions
In order to ensure the security of payments made by credit card, the Buyer must pass on to GLASS ONION the security code (CVV) indicated on the credit card used by the Buyer.
GLASS ONION also reserves the right to request a photocopy of the Buyer's identity card for any payment made by credit card, as well as any other information relating to the identity of the Buyer necessary to identify the buyer in order to ensure the security and correctness of transactions made through the GLASS ONION website.
As part of the fight against Internet fraud, information concerning the Order of the Buyer may be transmitted to third parties authorized by law or designated by GLASS ONION for the sole purpose of verifying the identity of the Buyer, the validity of the Order, the method of payment used and the place of delivery.
Article 5 – Product Delivery
5.1 General Rules
The products ordered by the Buyer according to these CGVs will be delivered to the address indicated by the Buyer as the delivery address on theOrder ('Delivery Address').
GLASS ONION ships to all European Union countries, including Monaco, excluding Cyprus and Malta. The following territories are also excluded: Vatican City, San Marino, Champion of Italy, Livigno, as well as territories of European Union countries outside the geographical area of Europe (e.g. the French DOM-TOM territories).
Purchase invoices are sent by e-mail to the e-mail address indicated by the Buyer at the time of registration on the GLASS ONION website.
5.2 How to ship products
5.2.1 Shipping modes for Italy
(I) Bartolini Expedition
A manager of the Bartolini company will deliver to the Buyer or recipient of the Order and will require them to sign an electronic receipt. This electronic receipt will be proof of the delivery by GLASS ONION, and the receipt by the Buyer, or the recipient of the Order, of the products ordered.
Deliveries are made on working days (Monday to Friday). In the event of absence, the Buyer, or the recipient of the products ordered, will receive an attempted delivery notice, with which they can contact the carrier at the address indicated on the notice in order to arrange a new delivery. If it is expressly indicated by the buyer, or by the recipient of the products ordered, it will be possible to deliver the products to a third party.
If it is not contacted, the Bartolini carrier will make a further step in the two working days depending on the case, following the first step. In the event that after two attempts to deliver the package could not be delivered, the Buyer or recipient of the Order will receive an alert informing the address of the Bartolini Center in which the package will be stored ten working days. The Buyer or recipient of the Order will be able to pick up the package at that centre. At the end of that period the package will be returned to GLASS ONION and the Buyer refunded, in the manner chosen at the discretion of GLASS ONION, the amount of his Order deducted the shipping costs.
It is not possible to raise any disputes relating to the shipment itself in case the package appears to have been delivered. To do this, the carrier's computer system (flashage) is faithful.
5.2.2 Delivery modes for countries other than Italy
5.3 Defects, non-compliance and product damage
5.3.1 General provisions
The Buyer, or the recipient of the Order, is invited to check the status of the package and products at the time of delivery.
In case of package anomalies (damaged or open package, trace of liquid, etc.) and/or products ordered (missing, defective or damaged products), the Buyer or recipient of the Order will have to return the products to GLASS ONION following the procedures described in articles 5.3.2 and 5.3.3 of these General Terms of Sale. Failure to comply with the correct procedure excludes any action against the carrier and/or GLASS ONION, including the right to refund the Order and/or the return of the products ordered.
The Buyer, or the recipient of the Order, may, alternatively, call GLASS ONION Customer Service to find out how to return the damaged, non-compliant and/or defective product or products. The procedure for returning damaged, non-compliant and/or defective products that will be indicated by GLASS ONION Customer Service must be followed by the Buyer. Otherwise, the Buyer will not be able to claim any refund or replacement of the products in question.
5.3.2 Procedures that must benecessarily followed in the case of obvious damage of the package for the return of the same to GLASS ONION:
– Bartolini Shipment:
In the event of an anomaly found in the presence of a Bartolini manager:
Reject the shipment and immediately formulate all the reservations regarding the anomaly in a clear and detailed manner. These reserves must be indicated by the Buyer or the recipient of the Order on the appropriate cutting of the bellboy Bartolini.
Report the rejection to GLASS ONION Customer Service at the same time.
In the event of an anomaly found in the absence of the manager Bartolini:
Report the damages or deficiencies found and make any complaint and reserve to GLASS ONION Customer Service.
5.3.3 Procedure that must be followed in case of product missing, damaged or defective:
The Buyer, or the recipient of the Order, must report the absence, defect, non-compliance or damage of the products ordered to THE GLASS ONION Customer Service.
GLASS ONION Customer Service may ask for information about the identity of the Buyer or recipient of the Order and make any verification that may be useful. GLASS ONION Customer Service will tell the Buyer, or the recipient, the procedure to follow to return the damaged or defective product, that is, to obtain the missing products.
Once the products are received, GLASS ONION will verify that these products are indeed defective, damaged or mismatched with the description provided on the Website. If this verification is positive, in accordance with Article 130 and following of the Consumer Code, GLASS ONION will replace the defective, damaged or non-compliant product and send it to the Buyer as soon as possible and in any case within 30 (thirty) working days of receiving the products. The shipping costs will be borne entirely by GLASS ONION. If GLASS ONION is unable to replace the products within that period, GLASS ONION will immediately notify the Buyer of the e-mail address indicated at the time of registration and will reimburse the Buyer the cost of those products and shipping costs if the Buyer provides proof of the cost incurred to return the products. The refund of the price will be made by GLASS ONION with the manner chosen at its discretion as soon as possible, and in any case within 30 (thirty) working days from the date on which you will receive the products.
If, after reviewing the returned products, GLASS ONION reasonably believes that the products cannot be considered defective, damaged or non-compliant with the description on the Website, the Buyer will not be entitled to a refund and the products will be returned to him.
5.4 Shipping Times and Costs
The shipping times of the products in Italy (via Bartolini) are between 3 and 5 business days considered with reference to the French or Italian calendar, as appropriate. For shipments to the islands of Sicily and Sardinia, these times may be extended by 1-2 working days considered with reference to the French or Italian calendar, depending on the case.
The delivery time takes place from the moment the e-mail confirms that the products have been shipped to the Buyer.
The shipping costs are: 6th up to 100 euros of order, over 100 euros shipments are free, 10.00 euros for shipments in marking.
Article 6 – Rights and terms of withdrawal
6.1.Right and terms for termination
6.1.1. Term for the exercise of the right of withdrawal
Under the terms of theArticle 64 of the Italian Consumer Code, the Buyer may, within the period of 10 (ten) working days from the date of receipt of the package containing the ordered goods, withdraw from the purchase agreement without penalty and for no reason.
In the case of the purchase of a service, the right of withdrawal may be exercised by the Buyer, within that period, provided that the provision of that service has not yet begun. The GLASS ONION Gift Card must be understood as a service under this clause.
6.1.2. How the right of withdrawal is exercised
The manner in which the right of withdrawal is exercised is described in Article 6.3 of these General Terms of Sale.
6.1.3. Consequences of the exercise of the right of withdrawal
The Buyer, exercising the right of withdrawal under this article, within the terms and manner described below for the return of the products, will be able to obtain at his choice:
– the refund of the amount paid for the returned products, by recrediting the amount on the credit card or glass ONION gift card, that is, if the Order has been paid through the use of Online Vouchers, the refund will be made through online vouchers on the GLASS ONION account;
– the possibility to exchange, only in an Italian GLASS ONION store, the products purchased on the GLASS ONION website with other products sold in Italian glass ONION stores; Or
– a credit equal to the price of the returned products, which can only be used on the GLASS ONION website.
Under Article 67 paragraph 3 of the Italian Consumer Code, the repayment costs will be borne exclusively by the Buyer.
6.2. Law and terms for the exercise of contract termination
Committed to ensuring the satisfaction of its Buyers and Recipients of Orders, GLASS ONION recognizes the Buyer and/or recipient of the Order the opportunity to withdraw from the purchase agreement, without reason and without the payment of penalties, even beyond the legal deadline specified above and the conditions of follow-up established.
6.2.1. Term of exercise of the right of contractual termination
The period within which the Purchaser and/or the recipient of the Order may exercise the right of contractual termination is 2 (two) months from the date of receipt of the Order.
6.2.2. How to exercise the right of contractual withdrawal
The manner of contractual termination is described in Article 6.3 of these General Terms of Sale.
6.2.3. Consequences of the exercise of the right of contractual withdrawal
The Buyer and/or the recipient of the Order exercising their right of contractual termination under the terms of this article within the terms of the article and in the following manner described for the return of the products purchased on the GLASS ONION website, may obtain a choice:
– the possibility to exchange, only in an Italian GLASS ONION store, the products purchased on the GLASS ONION website with other products sold by GLASS ONION;
– Online vouchers on the GLASS ONION account for a credit equal to the price of the returned products, which can only be used on the GLASS ONION website; Or
The return costs will be fully borne by the Buyer and/or the recipient of the Order, unless the withdrawal leads to the delivery of defective, non-compliant, damaged or missing products, in which case GLASS ONION will reimburse the Buyer and/or recipient of the Order the shipping costs under the previousArticle 5.3.3.
6.3. How the right of withdrawal is exercised
In the case of the right of withdrawal exercised under Article 6.1, the Buyer will be able to return the products ordered alternately by delivering them to any of the GLASS ONION stores located in the Italian territory, that is, by mail to the address indicated in Article 6.3.3 of these General Terms of Sale.
In the case of a right of contractual withdrawal exercised under Article 6.2, the Buyer and/or the recipient of the Order will be able to return the products ordered alternately by delivering them to any of the GLASS ONION stores located in the Italian territory, that is, by mail to the address indicated in Article 6.3.3 of these General Terms of Sale.
6.3.1. General provisions applicable to any return mode (return in store or mail)
Products must be returned to GLASS ONION in their substantial integrity, with their original packaging, accessories, instructions for use and what else with them provided.
The Buyer and/or the recipient of the Order must complete the appropriate Return Form, which can be downloaded from the GLASS ONION Website in the Help section duly signed, reporting the Order number (if that field was not already pre-filled on the Return Form). The use of the Return Module makes it easy to manage the return process by GLASS ONION. The Buyer or recipient of the Order, if different from the Buyer, is then invited to use the Return Form. For refunds in Italian GLASS ONION stores, you must submit a copy of the purchase invoice. The return of the products beyond the legal deadline for termination and termination will not be accepted. For services purchased on the GLASS ONION website, the return conditions described below will be applicable as long as the service provision has not yet begun.
6.3.2. In-Store Return
Return to the store is possible at any GLASS ONION store in Italy, except for compliance with the conditions of Article 6.3.1. General Terms of Sale.
6.3.3. Return by post
Except for Article 6.3.1 of these General Terms of Sale, the Buyer or recipient of the Order who wishes to exercise his right of withdrawal, legal or contractual, by returning a product by post, must follow the following instructions:
– use the original packaging to return the products in question.

GLASS ONION only accepts packages or recommended addressed correctly.
Any risk associated with the return of the products will be solely borne by the Buyer and/or recipient of the Order itself, unless the Purchaser/recipient of the Order proves that he has made the deposit of the products to be returned to a carrier or at a GLASS ONION store.
Article 7 – Property reserve
Ownership of the products ordered will remain in charge of GLASS ONION until the entire consideration of the Order, including shipping costs, taxes and other mandatory contributions (if provided) are fully paid by the Buyer.
Article 8 – Intellectual Property
Reproduction in all or part of the modification or use of such trademarks, illustrations, images and logos, or any other content of the Site, for any reason and by any means, without the express written permission of GLASS ONION and/or the respective intellectual property rights holders on them is strictly prohibited.
Article 9 – Signature and Test
GLASS ONION works to protect the personal information of its customers by providing a high level of security, but the Buyer also has a role in protecting their personal data. In particular, the Buyer must maintain the security of his online transactions, for example by refraining from communicating his username (the Buyer's e-mail address) and/or password to others and changing that password on a regular basis.
The use of the Buyer's registration/access password and/or password are proof of the Identity of the Buyer of the Right of GLASS ONION, at the time of the confirmation of the Order by GLASS ONION, to demand the relevant amounts. GLASS ONION's computer records will be proof of the communications, orders and payments between the Parties.
GLASS ONION and/or its business partners will in no way be responsible for the misuse and/or disclosure to third parties of the Buyer's registration/access information.
The provision of the credit card number and the final validation of the Order are proof of the acceptance of the Order and make the sums indicated for the purchase of the products indicated in the Order available. The computer records, stored in the computer systems of GLASS ONION and the partners of GLASS ONION, will be considered evidence of the communications, orders and payments that have taken place between the Parties.
Article 10 – Responsibilities
10.1. Ability to contract
The Buyer declares that he has the full capacity to act and enter into a contract to purchase the products and/or services on the Website on the basis of these General Terms of Sale. GLASS ONION will under no circumstances be required to verify the ability of visitors and buyers of the GLASS ONION website. If a person who does not have the necessary ability to act (e.g. a child) makes an Order on the GLASS ONION website, while remaining the responsibility of his parents or legal guardians for that Order and the payment of the order, GLASS ONION may refuse to accept the Order.
GLASS ONION will in no way be liable for any violations of these General Sales Terms, even if it is foreseeable, attributable to the fact of a third party, the fault of the Buyer, the occurrence of a major force event or any other event that is not reasonably under the exclusive control of GLASS ONION.
The information and content available on the Website are provided "AS IS" (in the state in which they are located) and GLASS ONION does not guarantee any kind, both expressed and implied, in relation to integrity, accuracy, timeliness, non-violation of third party rights, availability, reliability or completeness of information and content, including, but not limited to, information about products, accessories or services that appear on the GLASS ONION website and/or their suitability for a specific use. GLASS ONION will not be in any way responsible for the misuse ofproducts and/or services by the Buyer and/or recipient of the Order, and in particular for the case of non-compliance with instructions for the use of the products. GLASS ONION will not be in any way liable for any damage caused to the Buyer or to third parties resulting from that non-compliant use.
GLASS ONION DISCLAIMS ANY LIABILITY FOR DIRECT AND INDIRECT DAMAGES, WHETHER FORESEEABLE OR NOT, RESULTING AND/OR RELATED TO THE USE OF THE WEBSITE BY THE BUYER. IN THE EVENT THAT GLASS ONION IS HELD LIABLE FOR A DAMAGE SUFFERED BY THE BUYER AND ATTRIBUTABLE ONLY TO THE TRANSMISSION OF AN ORDER, THAT LIABILITY WILL BE LIMITED TO THE AMOUNT OF THE ORDER PAID BY THE BUYER TO GLASS ONION.
Nothing in these General Terms of Sale excludes or limits GLASS ONION's liability to the Buyer and/or recipient of the Order for fraud, death or personal injury caused by the negligence of GLASS ONION, violation of applicable forecasts of the Italian Consumer Code or any other liability that cannot be excluded or limited by law. Any complaints made by users of the Site, including all Buyers, against GLASS ONION must be filed within six (6) months after the occurrence of the event which is the subject of the complaint.
Article 11 – Personal Data
Article 12 – Changes
GLASS ONION reserves the right to modify and update the General Sales Terms without notice. In order to be informed of these changes, GLASS ONION advises the Buyer, and in general any user, to regularly read these CGVs and the "Legal and Privacy Information" of the Site. The purchase of the products on the Website will be subject to the CGVs in force at the time of the Order submission. The changes will not be applied to Orders already submitted and accepted by GLASS ONION.
Article 13 – General Clauses
13.1 Partial disability
If one or more provisions of these CGVs are declared invalid or ineffective due to a legislative change or following a ruling by a competent judicial authority. The other provisions of these CGVs will remain fully valid and effective.
The fact that one of the Parties does not claim a violation of any of the obligations contained in these CGVs is not to be understood as a waiver to obtain the fulfilment of the obligation in question for the future.
13.3 Applicable law and competent jurisdiction
These CGVs and all product sales on the Website are regulated by Italian law, regardless of the place of shipment of the Order.
